1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App. We may update these Terms from time to time, and your continued use of the App after any changes constitutes acceptance of the revised Terms.

2. Description of Service

Reliqe is an AI-powered mobile application that helps users identify and value secondhand, thrift, and vintage items. The App allows you to:

• Photograph items and receive AI-powered identification of brand, model, era, and condition.
• View real sold prices from public marketplaces including eBay, Mercari, and Poshmark.
• Calculate estimated profit after platform fees and shipping costs.
• Save items to a personal collection and track portfolio value over time.
• Access historical pricing trends and receive price alerts (Pro plan).

The App provides estimates and information for reference purposes only. Actual resale values may vary based on market conditions, item condition, listing quality, and other factors outside our control.

3. Account Registration

To use the App, you must create an account using your email address, or by signing in with Google or Apple. You agree to:

• Provide accurate and complete information.
• Keep your login credentials secure and not share them with others.
• Notify us immediately if you suspect unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

You must be at least 13 years old (or 16 in the EEA) to create an account and use the App.

4. Free & Paid Plans

4.1 Free plan

The free plan includes up to 3 scans per day, which reset at midnight. Free users have access to core identification and pricing features.

4.2 Reliqe Pro

Reliqe Pro is a paid subscription that provides unlimited daily scans, price alerts, historical pricing trends, and priority support. Subscriptions are billed through the Apple App Store or Google Play Store, and are subject to the respective platform's terms and billing policies.

4.3 Billing and cancellation

• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• You may cancel your subscription at any time through your device settings or the respective app store.
• Refunds are handled by the Apple App Store or Google Play Store in accordance with their refund policies.
• We reserve the right to change subscription pricing with reasonable notice.

5. Acceptable Use

You agree not to use the App to:

• Violate any applicable law, regulation, or third-party rights.
• Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Attempt to reverse-engineer, decompile, or disassemble the App or its underlying technology.
• Use automated scripts, bots, or other tools to access the App in a manner not authorized by us.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Resell, redistribute, or commercially exploit the App or its data without our written consent.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

The App, including its design, code, AI models, branding, and content, is owned by Reliqe and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without our prior written consent.

“Reliqe” and associated logos are trademarks of Reliqe. You may not use our trademarks without prior written permission.

7. User Content

You retain ownership of photos and other content you upload to the App (“User Content”). By uploading User Content, you grant us a limited, non-exclusive, worldwide license to process, store, and display your content solely for the purpose of providing and improving the App's services.

You are responsible for ensuring you have the right to upload any content you submit. We do not claim ownership of your User Content and will not use your photos to train public AI models outside of providing the scan service.

8. Disclaimers & Limitation of Liability

8.1 Disclaimer of warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the accuracy, completeness, or reliability of any AI identification, price estimate, or market data provided through the App. Valuations are estimates based on publicly available data and should not be relied upon as professional appraisals.

8.2 Limitation of liability

To the maximum extent permitted by law, Reliqe and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the App.

Our total liability for any claim arising from or related to these Terms or the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $50, whichever is greater.

9. Third-Party Services

The App integrates with third-party services to provide its functionality, including marketplace data providers, AI processing services, analytics platforms, and payment processors. These third-party services are governed by their own terms of service and privacy policies.

We are not responsible for the availability, accuracy, or content of third-party services or the marketplace data they provide. Links to marketplace listings are provided for reference and do not constitute an endorsement.

10. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App at our discretion, including if we reasonably believe you have violated these Terms.

Upon termination, your right to use the App ceases immediately. We will delete or anonymize your account data within 30 days of account deletion, except where we are legally required to retain it.

Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will remain in effect.

11. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you through the App or by email. The “Last updated” date at the top reflects the most recent revision. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Tennessee.
